The Kensington Pickleball Terms and Conditions

These Terms and Conditions ("T&C") apply to all court bookings, training classes, themed classes, social play sessions, private events, corporate events, coaching sessions, and use of facilities at Kensington Pickleball Club (the "Club"). By making a booking and paying the applicable fees, each customer agrees to be bound by these T&C. For any participant under 18 years old, the parent or legal guardian agrees to these T&C on the minor's behalf. Market practice among pickleball and sports clubs commonly includes advance booking controls, cancellation cut-off times, non-transferability, waiver language, and restrictions on unauthorised coaching.

1. General

1.1 The Club may update or amend these T&C from time to time. The latest version will be published on the Club's official website, booking platform, and/or social media channels. Continued use of the Club's services after publication of an updated version means acceptance of the revised T&C.

1.2 All bookings are subject to availability and to these T&C.

1.3 The Club may refuse, suspend, or cancel any booking or access rights if a person breaches these T&C, acts in an unsafe or disruptive manner, damages Club property, or misuses the booking system.

1.4 These T&C are written in simple legal English for customer clarity. They are intended to protect both the customer and the Club.

2. Booking Rules

2.1 All bookings must be made through the Club's approved channels, including the official booking platform, website, or WhatsApp.

2.2 A booking is only "confirmed" after the Club has received full payment and issued a confirmation.

2.3 Advance Booking Window. Advance booking of court hours may vary depending on the customer's membership tier, as set out in the relevant membership plan or booking policy. For training classes, themed classes, and social play sessions, customers may book as soon as the Club has published the relevant schedule. All bookings are accepted on a first-come, first-served basis. Priority booking by membership tier is a common market practice in Hong Kong pickleball clubs.

2.4 The Club may set a minimum and maximum number of participants for any class, social play session, or event.

2.5 If a session is fully booked, the Club may operate a waitlist. A waitlisted place is not confirmed until the customer is notified and full payment is received.

2.6 All bookings are personal to the customer and are non-transferable unless the Club agrees otherwise in writing.

2.7 A customer must not make speculative, abusive, or false bookings, including booking without genuine intent to attend, holding places for others without approval, or attempting to resell bookings. Clubs in the market commonly reserve the right to suspend accounts for booking abuse.

2.8 Cancellation Notification: The Club will notify customers of any class or session cancellations (including those due to the minimum participant requirement not being met) at least 24 hours before the scheduled start time.

3. Payment

3.1 Payment to Secure Booking: All bookings must be paid in full at the time of booking. Customers are required to fully settle all class/session fees at least 48 hours before the scheduled start time to secure the booking.

3.2 The Club reserves the right to release or cancel any booking if payment is not received at least 48 hours prior to the session

3.3 Accepted Methods: Payment may be made only by Faster Payment System (FPS) or bank transfer to the Club's designated account.

3.4 Acknowledgement of T&C. By making payment, the customer confirms that they have read, understood, and accepted these T&C. The Club should also require the customer to tick a digital acknowledgement box at checkout. Requiring express acceptance at the point of booking or payment is standard market practice for enforceability.

3.5 All prices are in Hong Kong Dollars unless otherwise stated.

4. Customer Cancellation and Refund Policy

To protect the Club's operational costs and court utilization, the following unified tiered refund policy applies to all bookings (Classes, Social Play, and Court Bookings):

4.2 Cancellation requests must be made through the Club's official booking channel or in writing by the method designated by the Club. Verbal requests do not bind the Club.

4.3 If the Club issues a credit instead of a refund, that credit must be used within 3 months from the original booking date unless the Club agrees otherwise in writing.

4.4 Credits are non-transferable, not redeemable for cash, and may only be used by the original customer.

4.5 Any registration fee, admin fee, or special event deposit stated to be non-refundable will remain non-refundable.

5. Cancellation or Changes by the Club

5.1 The Club may cancel or reschedule sessions due to low enrolment, weather, or operational reasons.

5.2 Minimum Class Size: For all training classes, themed classes, and social play sessions, if the minimum number of participants is not met at least 24 hours before the scheduled start time, the Club may cancel the session.

5.3 If the Club cancels a session under Clause 5.2, the customer may choose a full refund or a full credit.

5.4 The Club's liability for a Club-initiated cancellation is limited to the amount paid for the affected booking. The Club is not liable for travel costs, loss of opportunity, indirect loss, or any consequential expense.

6. Rescheduling by Customers

6.1 Training classes and themed classes. A customer may request to reschedule a booking if the request is made at least 48 hours before the original start time, subject to availability. Each booking may only be rescheduled once. The replacement booking must be of the same type or of equal value and must be used within 30 days of the original booking date.

6.2 Social play. A customer may request to reschedule a social play booking if the request is made at least 12 hours before the original start time, subject to availability. Each booking may only be rescheduled once. The replacement booking must be used within 30 days of the original booking date.

6.3 Court bookings. A customer may request to reschedule a court booking only if the request is made at least 24 hours before the original booking start time, subject to availability. Each court booking may only be rescheduled once. Requests made less than 24 hours before the original booking time will not be accepted. A 24-hour rescheduling cut-off is consistent with common sports venue practice because it helps protect court utilisation and late-fill risk.

6.4 The Club may refuse repeated rescheduling requests, abuse of the rescheduling process, or requests that would unfairly affect operations or availability.

7. Attendance, Attire, Conduct, and Coaching Rules

7.1 Customers should arrive at least 5 minutes before the scheduled start time. Late entry may be refused if it would disrupt the session.

7.2 If a customer arrives late, the session will still end at the scheduled time.

7.3 Appropriate Attire and Footwear. All players must wear suitable sports clothing and proper sports shoes suitable for indoor court use. Shoes with black soles or dark-coloured soles are not allowed on court. No customer may enter or play on court without proper sports shoes. The Club may refuse entry to court or stop play if footwear does not comply. Restricting unsuitable footwear is a common facility-protection rule in sports venues.

7.4 Customers must behave respectfully toward coaches, staff, guests, and other players. Dangerous, abusive, offensive, intoxicated, or disruptive behaviour may result in removal from the Club without refund.

7.5 Only coaches approved by the Club may provide coaching or paid instruction at the Club. External or unauthorised coaching is strictly prohibited. Restricting unauthorised coaching is a common club protection rule

7.6 The Club may set separate rules for social play, challenge court rotation, private lessons, junior classes, or special events.

8. Kids and Minors

8.1 Any participant under 18 years old must have a parent or legal guardian complete the required registration, acknowledgement, consent, and waiver before participating.

8.2 The Club may require a parent or guardian to remain on site for younger children, depending on the age of the child and the type of session.

8.3 For any kid-and-parent session or family play session, the supervising adult remains responsible for the child at all times unless the Club expressly states that the session is a supervised drop-off programme.

8.4 Children below the age threshold stated in the relevant programme description may be admitted free only where the Club has expressly published that pricing rule for that specific programme.

9. Health, Safety, Risk, and Liability

9.1 Pickleball, sports training, and related activities involve risk of injury. Each customer participates at their own risk.

9.2 Each customer is responsible for ensuring that they are medically fit and physically able to participate.

9.3 Customers should tell the Club before participation if they have a medical condition, injury, allergy, or special support requirement that may affect safe participation.

9.4 To the fullest extent permitted by law, the Club, its directors, employees, coaches, contractors, and agents are not liable for personal injury, death, loss, theft, or damage to property arising from participation in Club activities or use of Club facilities, except to the extent caused by the Club's proven gross negligence, wilful misconduct, or liability that cannot legally be excluded. Waiver and assumption-of-risk language is widely used by pickleball and sports operators.

9.5 The Club may seek emergency medical assistance for a participant if reasonably necessary, and the participant or guardian will remain responsible for any resulting cost.

10. Court and Facility Rules

10.1 Courts are for pickleball use and approved Club programming only. Food is not allowed on court, except as part of a private event booking or corporate event that has been approved by the Club in advance. Drinks are allowed only in sealed or secure containers.

10.2 Customers must leave the court and surrounding playing area promptly at the end of their booked time so the next booking can begin on time.

10.3 Customers are responsible for any loss or damage they cause to Club property, equipment, fixtures, or fittings, fair wear and tear excepted.

10.4 Operating Hours. The Club's standard operating hours are 10:00 a.m. to 10:00 p.m. daily, unless the Club announces otherwise. No person may enter or remain on the premises outside operating hours without prior approval.

10.5 The Club may issue additional house rules, event rules, or safety notices from time to time. Those rules form part of these T&C once published or displayed at the Club.

11. Photography, Video, and Promotion

11.1 The Club may take photographs or videos in the premises for operational, training, security, or promotional purposes.

11.2 If a customer does not wish to appear in promotional content, the customer should inform the Club in writing before the session.

11.3 Customers must not use photos or videos taken at the Club for commercial use without the Club's prior written consent.

12. Personal Data and Communications

12.1 The Club may collect and use personal data for booking administration, customer service, safety, payment verification, class management, and marketing in accordance with its privacy policy and applicable law.

12.2 By making a booking, the customer agrees that the Club may contact them by WhatsApp, phone, email, or other contact details provided in relation to their booking, reminders, schedule updates, payment status, and customer service matters.

13. Governing Law and Disputes

13.1 These T&C are governed by the laws of Hong Kong.

13.2 Any dispute arising out of or in connection with these T&C will be subject to the exclusive jurisdiction of the courts of Hong Kong, unless the Club chooses another dispute resolution process in writing.

14. Customer Acknowledgement

14.1 By making payment for a booking, each customer confirms that they have read, understood, and agreed to these T&C.

14.2 For online bookings, the customer must tick the acknowledgement box stating: "I have read and agree to the Kensington Pickleball Club Terms and Conditions, including the cancellation, refund, reschedule, risk, and liability provisions." Requiring active acknowledgement at checkout helps the Club show acceptance of the booking terms.

14.3 For a participant under 18 years old, the parent or legal guardian gives that acknowledgement on behalf of the minor.



The Kensington Pickleball 條款及細則

本條款及細則(「本條款」)適用於所有於 Kensington Pickleball (「本會」)進行之球場預訂、訓練班、主題班、社交玩法、私人活動、企業活動、教練課程及使用設施。
任何客戶一經預訂及付款,即被視為已閱讀、明白及同意受本條款約束。18 歲以下參加者,須由其家長或合法監護人代表其同意本條款。

一、總則

1.1 本會不時可修訂或更新本條款。最新版本將刊登於本會官方網站、預訂平台及/或社交媒體。客戶於更新後仍繼續使用本會服務,即視為接受修訂後之條款。

1.2 所有預訂均須視乎實際名額及本條款而定。

1.3 如任何人士違反本條款、行為危險或擾亂秩序、損壞本會財物,或濫用預訂系統,本會有權拒絕、暫停或取消其預訂及/或使用權利。

1.4 本條款以較淺白之法律中文撰寫,旨在同時保障客戶及本會。

二、預訂規則

2.1 所有預訂必須透過本會指定渠道進行(如官方平台、網站或 WhatsApp)。

2.2 本會收妥全數費用並發出預訂確認後,預訂方屬「已確認」。

2.3 優先預訂安排
球場預訂之可預訂日數,會按不同會籍層級而有所不同,詳情以相關會籍計劃或預訂政策為準。
訓練班、主題班及社交玩法,一經本會公布課程/時段表,即可接受預訂。所有預訂均以「先到先得」方式處理。香港多間球會及運動會所,均設分級預訂及優先預訂做法。

2.4 每一課程、社交玩法或活動,本會可自行訂明最少及最多參加人數。

2.5 如某時段已滿額,本會可設候補名單。候補名額並非即時確認,直至本會通知及客戶完成付款為止。

2.6 所有預訂只限該名客戶本人使用,不得轉讓予第三者,除非事先獲本會書面同意。

2.7 客戶不得作虛假、濫用或欺詐性預訂,包括:無真意出席而預訂、替他人長期佔位、或試圖轉售預訂名額等。多間同類場地如 Bay Pickle 也明文訂明,遇有預訂濫用可暫停帳戶及取消預訂。

2.8 取消通知: 如因人數不足或其他原因導致課堂或時段取消,本會將在預定開始時間至少 24 小時 前通知客戶 

三、付款

3.1 確保預訂之付款要求: 所有預訂須於預訂時繳清。客戶必須於課堂/時段開始前至少 48 小時 前全數撥款及清繳費用,以確保預訂有效 

3.2 如在開始前 48 小時 仍未收到款項,本會有權取消該預訂並將名額釋放予其他客戶 

3.3 付款方式
客戶只可透過「轉數快」(FPS)或銀行轉帳,支付至本會指定戶口。除非本會書面同意,概不接受其他付款方式。

3.4 直至本會指定戶口實際收到已過數之款項,方視為已「收妥付款」。

3.5 確認接納條款
客戶一經付款,即視為已閱讀、明白並同意本條款。本會亦會於網上預訂頁面設置「已閱讀並同意本會條款及細則」之方格,客戶須勾選確認。此種於付款前要求客戶明確同意條款之做法,為本地及海外會所普遍做法,有助日後執行。

3.6 所有價目均以港幣(HKD)計算,除非另有註明。

四、客戶取消及退款政策

為保障本會營運成本及球場使用率,下列統一退款政策適用於所有預訂(包括訓練班、社交玩法及球場預訂):

4.1 除非個別推廣/活動另有特別取消條款,下列為一般適用之取消及退款政策。

4.2 客戶取消必須透過本會指定之預訂渠道或書面(如 WhatsApp/電郵)提出。任何口頭或口訊「口頭留言」並不構成正式取消。

4.3 如本會按政策批出「積分」代替退款,該積分須於原訂預訂日期起計 3 個月內使用,逾期作廢,除非本會書面同意延長。

4.4 積分不得轉讓、不得兌換現金,只限原客戶本人使用。

4.5 如個別活動列明「報名費」、「行政費」或特別訂金不可退回,則不論任何原因,該部分一概不獲退款。

五、本會取消或更改安排

5.1 如有合理需要,本會可取消、合併、縮短、改期、調動教練,或對任何課程、社交玩法、球場預訂或活動作出更改。合理需要包括但不限於:報名人數不足、教練缺席、維修保養、安全或衛生理由、惡劣天氣、不可抗力或其他營運考慮。

5.2 最低開班人數

對於所有訓練班、主題班及社交玩法,如在開始前 24 小時 仍未達最低人數,本會有權取消該時段 

5.3 如本會因上述原因取消,已報名之客戶可選擇「全數退款」或「全數轉為積分」

5.4 本會就任何由本會主動取消之預訂,其責任以客戶就該預訂實際已繳付之金額為限。本會不會承擔任何交通費、時間損失或其他間接或相應損失。

六、客戶改期安排

6.1 訓練班及主題班改期
– 客戶如欲改期,須於原定課堂開始時間至少 48 小時前提出,並視乎名額供應而定。
– 每一預訂只可改期一次。
– 改期後之課堂須為相同類型或相同金額之課堂,並須於原訂日期起計 30 日內完成。

6.2 社交玩法改期
– 客戶如欲改期社交玩法,須於原定開始時間至少 12 小時前提出,並視乎名額供應而定。
– 每一預訂只可改期一次。
– 改期後之時段須於原訂日期起計 30 日內使用。

6.3 球場預訂改期(24 小時)
– 客戶如欲改期球場預訂,須於原定開始時間至少 24 小時前提出,並視乎球場供應而定。
– 每一球場預訂只可改期一次。
– 如少於 24 小時提出,恕不接受改期,亦不設退款或積分。
 24 小時之球場改期限期,符合一般球場租用及運動場地市場慣例,有助保障本會可於合理時間內重新出售該時段。

6.4 如客戶多次或過度使用改期安排,或改期要求嚴重影響本會營運或其他客戶權益,本會有權拒絕有關改期。

七、出席、服飾、行為及教練規定

7.1 客戶應於課堂/時段開始前至少 5 分鐘到達。逾時進場如會影響課堂秩序,本會有權拒絕其加入。

7.2 客戶因遲到而錯過之時間,本會恕不補回,課堂及時段仍會準時結束。

7.3 合適服裝及鞋履
– 所有球員必須穿著合適之運動服裝及合適之運動鞋。
– 一律禁止穿著黑色或深色鞋底之鞋履進入球場。
– 不得赤腳、只穿襪、穿拖鞋或其他非運動鞋於球場上活動。
– 如客戶之鞋履不符合規定,本會有權拒絕其進入球場或要求即時停止玩樂,而不會作任何退款或補堂。此類對鞋底顏色及鞋款之限制,為不少室內運動場地之通行做法,用以保護場地及地板。

7.4 客戶必須對教練、職員、其他會員及參加者保持禮貌及尊重。任何粗言穢語、侮辱、欺凌、暴力、醉酒或其他不當行為,本會有權即時請其離場,恕不退款。

7.5 只有本會認可及安排之教練,方可於本會場地內提供任何形式之教學或收費課程。嚴禁外來教練或未經本會批准之私人教練於本會場地進行教學或收費活動。此項限制為本港多間球會之慣常安排,以保障會方及其他教練之專業安排。

7.6 本會可就社交玩法、挑戰場、私人課程、青少年班及特別活動,另訂具體場內規則,並張貼或於預訂資訊中說明。

八、兒童及未成年人士

8.1 任何 18 歲以下之參加者,必須由其家長或合法監護人於首次參加前,填妥及簽署(包括電子方式)本會指定之登記、同意書及免責聲明。

8.2 視乎課程性質及年齡,本會可要求家長或監護人在課堂期間必須留在場地或會所範圍內。

8.3 如屬親子班、家庭玩法等時段,除非本會另有明確列明「代為照顧」安排,該兒童之安全及行為由其家長/監護人全權負責。

8.4 如本會於推廣或課程說明中列明某年齡以下之小童可免費參與,則以該條款為準,並只限於指定之課程或時段。

九、健康、安全、風險及責任

9.1 匹克球及其他運動活動本身存在受傷風險。客戶參與本會任何活動,均屬自願並須自行承擔相關風險。

9.2 客戶須自行確保身體狀況適合參與有關活動。如有任何疑問,應於參與前先諮詢醫生意見。

9.3 如客戶有長期病患、舊患、過敏、特殊需要或其他可能影響安全之情況,應於參與前主動通知本會。

9.4 在法律容許之最大範圍內,如非因本會嚴重疏忽或故意不當行為所直接導致,本會及其董事、僱員、教練、承辦商及代理人,概不就客戶於本會活動或使用設施期間之人身傷亡、財物損失或其他損害承擔責任。包括香港及外地多間匹克球及運動中心,均採用類似風險披露及免責條款。212hk+1

9.5 如情況緊急,本會可為客戶聯絡救護或醫療服務。任何相關費用由客戶或其家長/監護人自行承擔。

十、球場及場地使用規則

10.1 球場只供匹克球及本會認可之活動使用。除事先獲本會批准之私人宴會或企業活動外,球場範圍一律不得進食。
飲品必須存放於有蓋或防漏容器內,並放置於指定位置或場邊,不得隨意放置於場內。

10.2 客戶須於預訂之時段結束時準時離開球場及其周邊,以便下一時段準時開始。

10.3 客戶如蓄意或因嚴重疏忽而導致本會任何財物、設備、裝修或設施損毀,本會有權要求賠償修復或更換成本。

10.4 開放時間
本會一般營業時間為每日早上 10:00 至晚上 10:00,如有更改將由本會公布。除非事先獲本會書面批准,任何人士不得於開放時間以外逗留或使用場地。

10.5 本會可不時發布額外「會所守則」、「活動規則」或「安全指引」,一經張貼於場內或於官方渠道公布,即視為本條款之一部分。

十一、攝影、錄影及宣傳用途

11.1 本會可於場內進行攝影或錄影,用於營運、培訓、安全監察或宣傳用途。

11.2 如客戶不希望其肖像出現在本會宣傳物料中,應於活動前以書面通知本會,本會會在合理範圍內盡量配合。

11.3 客戶不得在未獲本會書面同意下,將於本會場地拍攝之照片或影片作任何商業用途。

十二、個人資料及通訊

12.1 本會可按照適用之私隱法例及本會私隱政策,收集及使用客戶之個人資料,用途包括預訂管理、客戶服務、安全管理、付款核對、課程安排及市場推廣等。

12.2 客戶同意本會可透過其所提供之 WhatsApp、電話、電郵或其他聯絡方式,向其發出預訂確認、提醒訊息、時間更新、付款狀態及相關客戶服務資訊。

十三、適用法律及爭議

13.1 本條款受香港特別行政區法律所管轄,並按其詮釋。

13.2 凡因本條款引起或與之相關之任何爭議,均以香港法院為專屬管轄法院,除非本會書面同意採用其他爭議解決機制。

十四、客戶聲明及接納

14.1 客戶一經就任何預訂付款,即確認已閱讀、明白並同意本條款。

14.2 網上預訂時,客戶須勾選確認聲明,例如:
「本人已閱讀並同意 Kensington Pickleball Club 條款及細則,包括取消、退款、改期、風險及責任等條款。 此類「主動勾選同意」安排,有助證明客戶已清楚接納相關條款。

14.3 如參加者為 18 歲以下人士,其家長或合法監護人須代表其作出上述聲明及同意。
